Treasury Rejects Coin Solution to Debt Ceiling Conundrum

From Ezra Klein on Washington Post
The Treasury Department will not mint a trillion-dollar platinum coin to get around the debt ceiling. If they did, the Federal Reserve would not accept it.
That’s the bottom line of the statement that Anthony Coley, a spokesman for the Treasury Department, gave me today. “Neither the Treasury Department nor the Federal Reserve believes that the law can or should be used to facilitate the production of platinum coins for the purpose of avoiding an increase in the debt limit,” he said.

Official White House Statement on Huff Post
There are only two options to deal with the debt limit: Congress can pay its bills or they can fail to act and put the nation into default," said Press Secretary Jay Carney. "When Congressional Republicans played politics with this issue last time putting us at the edge of default, it was a blow to our economic recovery, causing our nation to be downgraded. The President and the American people won't tolerate Congressional Republicans holding the American economy hostage again simply so they can force disastrous cuts to Medicare and other programs the middle class depend on while protecting the wealthy. Congress needs to do its job.

~~~~~~~~~~~~
With this, the White House has now ruled out the two best options for preventing a default in the event that the House GOP refused to life the debt ceiling. The White House has been quite adamant that the other alternative (invoking the 14th Amendment) is not acceptable.
So now the stakes are high, as The White House has refused to negotiate with the GOP on a debt ceiling hike.
What bargaining chips does The White House hold? Unclear.
~ Joe Weisenthal on Business Insider
. . . the last debt ceiling confrontation crept up on the White House because Obama refused to believe that Republicans would actually threaten to provoke default. Is the WH being realistic this time, or does it still rely on the sanity of crazies?
The thing is, the coin option sounds silly, but it clearly obeys the letter of the law. As far as I can tell, none of the other options — other than outright surrender — has the same virtue.
. . . And default in any of these senses would risk a huge collapse of confidence.
So is there a plan, or will it just be another case of tough talk followed by a tail-between-the-legs retreat?
Update: Nine Faces of the Platinum Coin from Talking Points Memo
...A stalwart band of merrymakers are finding a lot of fun Monday in the concept of a giant platinum coin.
~ Denny Gulino, MNI Financial News
From Joe Weisenthal on Business Insider
So where does the Trillion Dollar Platinum Coin fit in?
In the section of the law which specifically relates to the Treasury's ability to create money (coins and bills) section K says this:
(k) The Secretary may mint and issue platinum bullion coins and proof platinum coins in accordance with such specifications, designs, varieties, quantities, denominations, and inscriptions as the Secretary, in the Secretary’s discretion, may prescribe from time to time.
In other words, when it comes to platinum coins, the Secretary (who is currently Tim Geithner) has discretion on the designs, specifications, quantities, and denominations of platinum coinage.
So let's say, Tim Geithner decided to stamp out a $1 trillion coin. What does that accomplish?
The idea is that after it was created, Geithner could walk it over to the Federal Reserve, and deposit it in the Treasury's bank account. Then the Treasury, rather than having to issue new debt (because remember, Congress hasn't raised the limit) can make sure its checks clear against this money.
Voila, crisis averted!
Funny Money
Imagine sitting around the kitchen table, trying to figure out how you're going to pay off that next-generation HDTV you just bought.
Then someone has an idea. Brush off one of the old checker pieces in the attic, assign it a value of, say, $2,000 -- and use that newly minted "coin" to pay the credit card.
~ Fox News
I don't think there's even a remote chance that any court in the country would uphold a Treasury reading of this law that used it as a pretense for minting a $1 trillion coin.
. . . This whole notion is the kind of thing that Herman Cain would come up with. It's time to stop treating it seriously.
~ Kevin Drum on Mother Jones
. . . There is a Twitter hashtag – #mintthecoin – and a wan, spindly White House petition created on January 3 that needs around 25,000 signatures and currently has just under 2,000, which makes it resemble the winsomely pathetic Charlie Brown Christmas tree.
. . . This is an elegant solution – if you are a cartoon villain given to sitting in a vast underground bunker and innovating plans for world domination while petting a white cat. It makes less sense for real mortals. In fact, it has all the aspects of a group of well-financed mad scientists plotting to create a giant slingshot to avert an asteroid hurtling towards the earth.
~ Heidi Moore on Guardian UK
There’s exactly zero chance that the House Republicans, faced with the Coin Threat, will suddenly turn logical and decide that they’re not going to play political games around the debt ceiling after all. Rather, the Coin Threat is a political game, played by the other side: it’s the executive branch bringing itself down to the House Republicans’ level.
If you believe that the country is best run by grown-ups, you can’t believe in #mintthecoin, because it simply isn’t a grown-up strategy.
~ Felix Salmon on Reuters
My bill will take the coin scheme off the table by disallowing Treasury to mint platinum coins as a way to pay down the debt.
~ Congressman Greg Walden, R-Oregon, on a bill in which he wants to make it illegal to mint coins to pay the national debt
"That's silly/zany/juvenile!" This is probably true, but it's not a dispositive objection. Republican intransigence over the debt ceiling is juvenile. There is no particular reason that the president should not use a juvenile strategy in response.
The key question to ask about the platinum coin is not "is it juvenile?" but "will it work?" Minting the coin will allow the federal government to continue to meet its spending obligations despite hitting the debt ceiling. It will allow President Barack Obama to pressure Congress to repeal the debt ceiling. That -- not whether it seems silly -- is the important thing.
~ Josh Barro on Bloomberg
Photobucket
Should President Obama be willing to print a $1 trillion platinum coin if Republicans try to force America into default? Yes, absolutely. He will, after all, be faced with a choice between two alternatives: one that’s silly but benign, the other that’s equally silly but both vile and disastrous. The decision should be obvious.
. . . Enter the platinum coin. There’s a legal loophole allowing the Treasury to mint platinum coins in any denomination the secretary chooses. Yes, it was intended to allow commemorative collector’s items — but that’s not what the letter of the law says. And by minting a $1 trillion coin, then depositing it at the Fed, the Treasury could acquire enough cash to sidestep the debt ceiling — while doing no economic harm at all.
So why not?
~ Paul Krugman
There are two possible trump cards for Obama. One is the “platinum coin” option, in which the government mints a trillion-dollar coin and uses it to pay its debts... There’s also the 14th Amendment option, which some legal observers believe empowers the President to ignore the debt ceiling.
. . . Obama appears cool to both ideas. But Scott Wagner, a former NYPD homicide detective with extensive experience negotiating hostage crises, says the President needs to at least hint at a willingness to pursue an alternative endgame. A hostage negotiator needs to persuade a hostage taker that he is totally isolated and that the negotiator is the only one who holds the key to his way out — that “deep down, he is not in control of the situation.”
Greg Sargent on Washington Post
Petition on WhiteHouse.Gov
Direct the United States Mint to make a single platinum trillion dollar coin!
With the creation and Treasury deposit of a new platinum coin with a value of $1 trillion US Dollars, we would avert the absurd-yet-imminent debt ceiling faceoff in Congress in two quick and simple steps! While this may seem like an unnecessarily extreme measure, it is no more absurd than playing political football with the US -- and global -- economy at stake.
Grover Norquist in Wonderland
Transcript Via Raw Story
Andrea Mitchell: Why were you in favor of this? This is the first tax increase Republicans have voted for in 20 years.
Grover Norquist: Because, of course, no Republican voted for a tax increase. What happened was [President Barack] Obama had this Sword of Damocles over the heads of the American people with a $5 trillion tax increase over that next decade that would happen automatically unless the House, Senate and president voted on something.
The tax increases that he insisted on, all the Republicans in the House and the Senate have voted more than once to extend the Bush tax for everyone permanently. So, the Republicans are quite clear, they want the tax cuts extended for everyone. The president insisted on taking them away from some people. That’ll hurt the economy. He got his tax increase, but he can’t claim Republican fingerprints on his tax increase.
Mitchell: (laughing) Wait a second. I mean, we’re not living in the ‘Alice in Wonderland’ world here. There is a tax increase for wealthier Americans. It’s literally a tax increase. Rates are up.
Norquist: Well, what happened yesterday is that all the rates went up and then the Republicans and the Congress together took them down for some people, not for everybody. There was an automatic tax increase, a whole series of tax increases, which were then countermanded in a second bill.
Blah, blah, blah, blah, blah. The same of lies from the same old liar. He is saying black is white, up is down, and cold is hot. He could not tell the truth if the actual sword of Damocles was above him and about to chop off his fat head. This man is no longer a threat to anyone.
GOP Has a Sad About Fiscal Cliff Loss
Photobucket
I have to admit that Obama makes Bill Clinton look like an amateur when it comes to politics.
~ comment by MinorityRepublican on Free Republic
The Republican Party is dead. The GOP-e has killed it. I am not drinking their lesser-of-two evils, Dem-lite Kool-Aid anymore.
comment by Buddy on Free Republic
It's always the same, wait, just wait until this or that hits the fan. In the mean time the Republicans keep giving in to the left, and now it's Obama they keep giving in to. When will they hold the line until the left gives in? Just once in my friggen life I would like to see them HOLD! But they never do, and they never will.
They hold the purse, yet they allow Obama to stick his hand in and take what ever he wants because they are afraid of him and the media. Screw the media.
It is time to say no, regardless of what you are called or what lies they tell. Integrity starts with doing the right thing regardless of the lies told about you. The Republican establishment controls the party, and they have no integrity.
So because they cannot stop themselves from dealing with the devil, it's time for us to say no to them. We are beyond the brink, it is now time.
The McConnell Tax Hike will become law of the land. Mitch McConnell can and should take responsibility for it.
. . . The Republican Establishment in Washington, DC should be burned to the ground and salt spread on the remains. Republicans who saw Mitch McConnell and John Boehner destroy the last plank of the Republican Party are going to need to look elsewhere for a savior for their party. Boehner and McConnell have declared they will survive. Their party? They don’t really care.
Conservatives must look elsewhere. I do not advocate a third party. I advocate bring fresh blood into the GOP.
~ Erick Erickson on Red State
As it happened, Boehner's attempt at herding cats failed miserably, the House lost any leverage or credibility in the fiscal cliff negotiations and have been left as nothing more than a rubber-stamp on whatever Obama and the Democrat Senate was prepared to pass.
~ comment by Rich on Red State
Boehner is an Ohio Republican, the writing is on the wall. Boehner looses his job if Obama doesn't like him, so he prostrates himself, and sells the rest of us down the river. Boehner is like all blue state conservatives, just looking for cover anywhere they an find it. Our future is in Obama's control and I don;t see too many Conservatives talking about how to govern blue states, or win big blue cities.
~ comment by Wm on Red State
Look in the mirror: you (and me) are the fools. Boehner and McConnell and nearly the entire GOP Senators (and we'll soon find out probably at least half the GOP House) are not conservatives getting tricked into being progressives. They are progressives tricking you (and me) into thinking they are sometimes conservative. This was an easy call for anybody with a conservative inkling to vote against. All the pretend "negotations" between the President, and Harry Reid, and Biden, and McConnell, and then Boehner wouldn't budge, and then McConnell was driving a hard bargain, then....blah, blah, blah, they're drinking Scotch during these "meetings" plotting what the next "impasse" will be to keep dragging you and me along - it's all a show folks! The GOP leadership and the Obama administration and Democratic party are ONE IN THE SAME. They need each other to keep themselves in power. I for one am done being the GOP's useful idiot. 1988 was the last time we had a conversative leader of our party. 25+ years is too long.
Fiscal Cliff Compromise Makes Both Sides Unhappy - Updated
Victory? No, Liberals Think Obama Caved
Conceder In Chief?
OK, now for the really bad news. Anyone looking at these negotiations, especially given Obama’s previous behavior, can’t help but reach one main conclusion: whenever the president says that there’s an issue on which he absolutely, positively won’t give ground, you can count on him, you know, giving way — and soon, too. The idea that you should only make promises and threats you intend to make good on doesn’t seem to be one that this particular president can grasp.
And that means that Republicans will go right from this negotiation into the debt ceiling in the firm belief that Obama can be rolled.
~ Paul Krugman on New York Times
Obama Caves on Taxes
The White House and Senate leaders reached a bipartisan compromise on the fiscal cliff that would allow tax rates to rise on income over $450,000 and delay steep automatic federal spending cuts for two months.
Two months? He sold out his chief campaign promise for a two month delay? How could someone this bad at negotiating get such great deals in the Chicago real estate market?
The deal plays perfectly into Republican hands. Senator Graham admitted on the Senate floor that he considered this deal “Round 1″ and the Debt Ceiling agreement “Round 2.” In other words, get ready for another shakedown to protect the rich at the expense of everyone else. And if it was not clear before, Obama has every intention of screwing those relying on social programs – in fact, he already did so by moving the needle from 250,000 to 450,000. That is a lot of lost revenue to make up for in cuts.
CNBC's Maria Bartiromo Shrieks at a Democrat and Traders Cheer
Photobucket
Bartiromo: Are you guys just incompetent or what? I mean, if you can't do this, if you can't do what the American people pay you to do, why don't you just step aside and put somebody in there who can actually get a deal done?
. . . You're talking about $1.2 trillion in revenue, but you're not prepared to put anything on the table. People are not stupid.
. . . Cardin: The easiest way to get the revenues is to get the rates on the higher-income taxpayers.
Bartiromo: That's all you want to do. That's it. It's your way or the highway. Raise the rates on the rich. No other way. Your way or the highway. That's it.. That's where we are. Thank you, Senator.
Cardin: Next time, let me answer the questions --
Bartiromo: Oh, you've answered them. Clearly.
I'll give her one cheer for clearly exposing Democrats' "my way of the highway" approach. She missed the opportunity to get to three cheers because it seems that she's just now recognizing after all these months that Democrats, including President Obama, won't accept any kind of a solution that doesn't involve raising the top rates -- even though they've been saying that very thing all along. ~ Tom Blumer on Newsbusters  . . . from time to time, you just have to give credit where credit's absolutely, positively due. Because if this thing hasn't gone viral yet, it damn well should. Yesterday on CNBC, host Maria Bartiromo schooled a United States senator. I won't even mention his name. I Love her but I really thought she was just a Bully and did nothing but trivialize what is going on. Boehner is jerking us all around. He doesn't have the votes nor the Intestinal Fortitude to go against those who have bought Congress. He can't control his caucus. We had an election we voted for taxes being raised on those over 250K and Obama has given even more. We knew what we were voting for. The Republicans have to face reality They LOST. Boehner's Epic Fail in the House
Photobucket
Previous Post:
Snark Amendment: Boehner Shambles: Plan B Fails in House - Tea Party Gloats - Stock Market Falls
The House did not take up the tax measure today because it did not have sufficient support from our members to pass. Now it is up to the president to work with Senator Reid on legislation to avert the fiscal cliff. The House has already passed legislation to stop all of the January 1 tax rate increases and replace the sequester with responsible spending cuts that will begin to address our nation's crippling debt. The Senate must now act.
~ Statement of House Speaker John Boehner, via Huffington Post
Inside the Meltdown
At a quarter to 8 p.m. on Thursday night, House Republicans gathered in the Capitol basement for an urgent, closed-door conference meeting. The scene was hushed and confused. Instead of huddling in a windowless room, members thought they’d spend the evening on the House floor, voting on “Plan B,” Speaker John Boehner’s fiscal-cliff proposal. But as they took their seats and looked at Boehner’s face, the reason for the gathering became clear: The speaker didn’t have the votes. The whipping was over. “Plan B” was dead.
. . . It was Boehner’s tone and body language that caught most Republicans off guard. The speaker looked defeated, unhappy, and exhausted after hours of wrangling. He didn’t want to fight. There was no name-calling. As a devout Roman Catholic, Boehner wanted to pray. “God grant me the serenity to accept the things I cannot change,” he told the crowd, according to attendees.
. . . Boehner had spent weeks negotiating with his members and the president. But in this final hour, when he needed Republicans most, he had only a prayer.
~ Robert Costa on National Review
Boehner was trying to play chess and the caucus was playing checkers. Boehner is willing to lose a pawn for a queen. I’m not sure about the rest.
~ Senior Member of Congress quoted on National Review
Once again Obama's superior negotiating skills, which baffle those who mistake chess for checkers, has revealed to the world the true nature of the GOP: short-sighted, evil, predatory, beholden to the 0.01%.
In the end this was a battle b/t Obama and Boehner, and Boehner lost. Lost BIG! Lost because his own team stabbed him in the back. And all Obama had to do was consider Boehner's proposal for the GOP to reject it. Because the GOP will commit suicide rather than deal honestly with that Black guy in their White House.
~ OnlyWords on Daily Kos
I have to say that I didn't think the GOP would screw Boehner like this. That they would be so extreme. I thought they'd opt to preserve the Kabuki drama in which they play the part of an organized, determined, powerful force.
And I'm so relieved that they opened the door for President Obama to walk through, turn around, and say "thank you. Now chained CPI and SS cuts are off the table. Don't mind if I do."
The cliff is upon us. The end of fiscal days, or so House Republicans tell us. The House Republicans want you, the American people to know that they are serious about the fiscal cliff. They are so serious that they have decided to go home for Christmas.
. . . If House Republicans were serious about the fiscal cliff, they could earn some of those millions that we pay them every year and actually do what is expected of most Americans. They could work on a holiday.
~ Jason Easley on PoliticusUSA
If we go over the fiscal cliff, the president just comes back and says, 'Ok, we're going to give tax cuts to everybody under 250,000.' Who's going to vote against that? Everybody'll vote for that. Everybody. It will be just a fait accompli. You won't be voting on whether you're going to do away with a tax cut, you're going to be reimposing tax cuts for everybody under 250,000. So the Republicans are in an untenable situation.
~ Congressman Dan Burton, R-Indiana
It is now clear that to protect the middle class from the fiscal cliff, Speaker Boehner must allow a bill to pass with a combination of Democratic and Republican votes. Speaker Boehner’s partisan approach wasted an entire week and pushed middle-class families closer to the edge. The only way to avoid the cliff altogether is for Speaker Boehner to return to negotiations, and work with President Obama and the Senate to forge a bipartisan deal.
~ Adam Jentleson, spokesperson for Senate Majority Leader Harry Reid
The reason we're here is because our Republican colleagues refuse to compromise. We are wasting the people's time.
~ Congressman Chris Van Hollen, D-Maryland
These conservatives — well-intentioned, perhaps, but tactically foolhardy — are steering the Republican party and the movement into an iceberg that’s been in plain sight for weeks. I’d say I’m in disbelief, but this clown show has been going on too long now to say that.
Boehner Shambles: Plan B Fails in House - Tea Party Gloats - Stock Market Falls
Photobucket
ThinkProgress
House Republicans revolted this evening and rejected Speaker John Boehner’s “Plan B” which would have extended the Bush tax cuts for everyone making $1 million or less, among other provisions. According to Boehner, he canceled a scheduled vote on his plan after it became clear he could not get enough support from Republicans for it to pass. The House is now in recess until after Christmas.
Talking Points Memo - Tea Partier Huelskamp Gloats
Rep. Tim Huelskamp (R-KS), one of the conservative lawmakers "purged" from a committee seat by House leadership earlier this month, issued a release gloating over the fact that Speaker John Boehner's "Plan B" to avert the so-called fiscal cliff failed on Thursday night due to lack of support.
"On a separate note, Republican leadership thought they could silence conservatives when they kicked us off our Committees," Huelskamp said. "I’m glad that enough of my colleagues refused to back down from the threats and intimidation, thus preventing the Conference from abandoning our principles."
