Supreme Court Hears #HobbyLobby Case

The Supreme Court on Tuesday heard the case brought by crafts superstore Hobby Lobby. While the women of the Court were understandably pro-women and came out swinging, Justice Scalia seemed to think birth control is no big deal for women, even if they have to pay for something they already pay for out of the company premium. It's depressing that the men on the court don't seem to fathom the way insurance works - we saw that in the debate over Obamacare as well.

But even more distressing is that the religious right is predicting victory in this case and so are many in the media. The right-wingers are equating ANY birth control with abortion now, and any woman who uses it is some kind of cold-hearted killer. I saved their nonsensical pronouncements for another post:

It's true that Hobby Lobby may win their case, but this is hardly a win for the GOP, who seems hell-bent on insulting and alienating women until the party goes extinct. And I'm not sure even the most anti-Left of the Supremes will say business owners can just flout any law they choose in the name of religion - rather they may rule in some narrow way instead of a sweeping generality about all businesses and religions. We won't know until June when the verdict is read, since another medieval thing about SCOTUS is the length of time it takes them to write up decisions. Stay tuned.

On the one side is the Hobby Lobby arts-and-crafts chain and Conestoga Wood Specialties cabinetry company, both owned by devout families. On the other is the federal government, which argues that the landmark 2010 health care law gives women a statutory right to choose among 20 methods of birth control.

The court, judging from the justices’ questions, is clearly divided on this potential earthquake of a religious rights case. It could be yet another instance where Justice Anthony Kennedy provides the swing vote — in this case whether a corporation has religious rights, and whether those rights in this case have been trampled.

Hobby Lobby, owned by the Green family, and Conestoga, owned by the Hahns, object to paying for the full range of birth control drugs and devices as required by the Affordable Care Act. To them, a handful of the methods they must cover could cause abortion. Including these methods in their companies’ insurance package is, in their eyes, sinful.

A key moment came near the end of the argument when Kennedy and Roberts raised the issue of abortion.

"Under your view, a profit[-making] corporation could be forced in principle to pay for abortions," Kennedy said.
That is true in principle, Verrilli said, but he added that no law "requires for-profit corporations to pay for abortions."
Roberts sounded surprised. "I thought that's what we had before us," he said.

The exchange made clear that the administration faces an uphill fight. If Roberts and Kennedy decide to view the case as a test of whether the government can ignore a business owner's religious beliefs and force him to provide for abortions, the government would likely lose.

Mike Huckabee - #UncleSugar and the Feminine Libido

Ex-Gov of Arkansas, sometimes Preacher, and Tea Party Conservative Mike Huckabee really stepped in some deep Man-ure on Thursday when he decided to talk about Ladyparts and Birth Control. You just have to read it to believe it. If this attack on women is rebranding, then the GOP deserves all the Fail it can get. And for delighted Democrats on Twitter, it was a day to give Huckabee a new nickname - "Uncle Sugar."

I think it’s time Republicans no longer accept listening to the Democrats talk about a 'war on women,'" Huckabee said during a speech at the Republican National Committee's winter meeting in Washington. "The fact is the Republicans don’t have a war on women, they have a war for women, to empower them to be something other than victims of their gender.”

Huckabee said Democrats rely on women believing they are weaker than men and in need of government handouts, including the contraception mandate in Obamacare.

"If the Democrats want to insult the women of America by making them believe that they are helpless without Uncle Sugar coming in and providing for them a prescription each month for birth control because they cannot control their libido or their reproductive system without the help of the government, then so be it," Huckabee said. "Let's take that discussion all across America."

#GOP Heads Explode On Election Night as Cuccinelli Loses, Christie Wins

Democrat Terry McAuliffe edged out Virginia attorney general Ken Cuccinelli in the race to be the state’s next governor on Tuesday, riding a significant financial advantage and voter distaste over the Republican’s staunchly conservative stances on social issues to victory in the key swing state.
The contest was close late into Tuesday night after polls had indicated McAuliffe, a former Democratic National Committee chairman and close Clinton confidante, could win by high single digits. But with 96% of precincts reporting, McAuliffe led Cuccinelli 47.1% to 46.3%, and the Associated Press called the race for McAuliffe at about 10 p.m. E.T. A third candidate, libertarian Robert Sarvis, ended up winning a critical 6.7%.
It’s the first time the party occupying the White House has won the state’s off-year gubernatorial election since 1973.

The Republican Governors Association took umbrage Wednesday at anonymous griping that it abandoned Ken Cuccinelli’s gubernatorial bid, highlighting the $8.5 million it spent to help the Republican state attorney general against Democrat Terry McAuliffe.
The tit-for-tat played out a day after Cuccinelli lost by less than three percentage points, a margin that was much narrower than expected and triggered second-guessing and finger-pointing about what might have been.

"Eclair" Christie and the Bubble Boys

(The Cuccinelli Campaign in Virginia) begged Christie, and you can make an argument that to bring a Chris Christie to Northern Virginia might have helped. But Chris Christie is worried about his own brand.

That is the brand Christie needs to worry about.
Had Christie taken just a half-day to stump for Cuccinelli, not only would that have helped wash the Sandy stain away; it might have actually made him a hero to the base for both defying the Morning Joe crowd and helping to drag Cuccinelli over the finish line.

No more Money for RNC

Open letter to the RNC- Sirs, I am not and have never been a member of the Tea Party. What if?

If there had been late spending for Cuccinelli, or if there hadn't been a government shutdown, right, which is not Ken Cuccinelli's fault, if there hadn't been, you think of the Northern Virginia vote, where there are a huge number of huge number of government workers in Northern Virginia, where Terry McAuliffe found his margin of victory.
If there hadn't been for the shutdown, Ken Cuccinelli might have won this race also for all of his problems, a little bit more money, and a little bit less government shutdown, you might be looking at Ken Cuccinelli as bad as he was, and as out of step with so much of Virginia, he probably would be in the statehouse.

Virginia is not liberal; NORTHERN Virginia is. Arlington, Fairfax and Prince William Counties alone gave McAuliffe the nod by a margin of 107,000; STATEWIDE, it was only 55,000. Most of these hacks only reside there due to the fact that they are part of the "political-industrial complex." Bigger government, whether it be state or federal, gives these hacks (so they think) more job security. Apparently, it's a bunch of transplants, as opposed to native Virginians, who now decide the future of the Old Dominion. Thomas Jefferson would be rolling over (and vomiting) in his grave.

For decades, Mexicans have been about 30 percent of all legal immigrants to the United States, while only a smidgen more than 1 percent come from Great Britain. Is that fair? Granted, their food is better, but why is it the norm is to have nearly 30 times as many Mexican as British immigrants?
We have been taking in more immigrants from Guatemala, the Dominican Republic and Colombia, individually, than from England, our mother country. There are nearly twice as many immigrants from El Salvador as from Canada, and 10 times as many as from Australia.
. . . Mexicans are the largest immigrant group in America, with about 50 million Hispanics living here legally.
Marco Rubio's amnesty bill will soon make it 80 million. First, there are at least 11 million illegal immigrants, a majority from Mexico, who will be instantly legalized. Then we'll get their entire extended families under our chain migration system.
I wouldn't want that many Japanese! I wouldn't want that many Dutch (not that there are that many Dutch)! Why do we have to become a different country? Was there a vote when the country decided to turn itself into Mexico? No other country has ever just decided to turn itself into another country like this.

Three marquee proposals for anti-abortion lawmakers failed to gain traction: a bill that would have banned abortions after the 20th week of pregnancy, a bill that would increase regulations for abortion facilities and a bill that would require doctors who perform abortions to have admitting privileges to a hospital within 50 miles.
. . . Last session — with an early boost from Perry — Republicans pushed proposals that forced women to undergo sonograms 24 hours prior to having an abortion and that slashed millions of dollars to family planning services.

At a Thursday congressional committee hearing on a proposed ban on abortion at 20 weeks in Washington, D.C., Christy Zink, a mother of two, testified how the measure would harm women who require late-term abortion care due to fetal abnormalities and other potentially fatal complications.
. . . In response to Zink’s testimony, Rep. Louie Gohmert, R-Texas, expressed “sympathy” for Zink, then accused her of “ripping apart” her fetus:
Ms. Zink, having my great sympathy and empathy both. I still come back wondering, shouldn’t we wait … and see if the child can survive before we decide to rip him apart? So, these are ethical issues, they’re moral issues, they’re difficult issues, and the parents should certainly be consulted. But it just seems like, it’s a more educated decision if the child is in front of you to make those decisions.

Contraception is Bad ~ For All Kinds of Scary Made-Up Reasons

They’re all abortion and HIV. HIV’s kind of hard to catch. Abortion happens if you get pregnant. But we’re on the track for 50 percent of the American people to have Herpes by the time these kids are my age. And that is a profound — not only health but sociological crisis facing this country.”

During contentious debate over the Farm Bill, which funds food stamps, in the House Agriculture Committee, Rep. Juan Vargas, D-Calif., invoked the Book of Matthew as he noted his opposition to the cuts.
“[Jesus] says how you treat the least among us, the least of our brothers, that’s how you treat him,” Vargas, adding that Jesus specifically mentions the importance of feeding the hungry.
Republican Congressman Stephen Fincher of Tennessee, who supports cuts to the program, had his own Bible verse from the Book of Thessalonians to quote back to Vargas: “The one who is unwilling to work shall not eat,” he said.

Now, this would not normally be worthy of mention. Hardly a day goes by without some Republican sadist expressing fury that poor people have it so good. Devising new ways to make the peasants suffer is what makes Republicans wake up in the morning. What's fascinating about this particular case, though, is Fincher's background.
The reason this is even more egregious than the usual Republican class warfare is that Fincher himself is a poster boy for government dependency. It's not just that he's benefited here and there from some government help. That sort of low-level hypocrisy is almost to be expected from these types. But Fincher has received millions - $3.2 million as of June 2010 - in federal crop subsidies.

Danger! ~ Lowering Grocery Tax Will Lead the Poor to Buy More Food

The Kansas state Senate on Thursday voted to cut the state sales tax on food from 6.3 percent to 4.95 percent, but Sen. Jeff Melcher (R) led opposition against the measure, arguing that it would lead to people eating more.
“It seems to me we are encouraging the behavior of purchasing food and discouraging the behavior of purchasing anything else,” Melcher reportedly told his colleagues.

Last week, Paul Ryan gave an interview in which, defending his position that there should be no excuses for abortion, he referred to rape as a "method of conception."
Wow, right? Talk about a benign euphemism. Rape -- RAPE! -- is now a "method of conception." You know, like love-making, just without the love.

“Forcible rape” had been defined by the UCR SRS (Uniform Crime Report Summary Reporting System) as “the carnal knowledge of a female, forcibly and against her will.” That definition, unchanged since 1927, was outdated and narrow. It only included forcible male penile penetration of a female vagina.

The new definition is: “The penetration, no matter how slight, of the vagina or anus with any body part or object, or oral penetration by a sex organ of another person, without the consent of the victim.”

For the first time ever, the new definition includes any gender of victim and perpetrator, not just women being raped by men. It also recognizes that rape with an object can be as traumatic as penile/vaginal rape. This definition also includes instances in which the victim is unable to give consent because of temporary or permanent mental or physical incapacity.
Furthermore, because many rapes are facilitated by drugs or alcohol, the new definition recognizes that a victim can be incapacitated and thus unable to consent because of ingestion of drugs or alcohol. Similarly, a victim may be legally incapable of consent because of age. The ability of the victim to give consent must be determined in accordance with individual state statutes. Physical resistance is not required on the part of the victim to demonstrate lack of consent.

...The wording he used is misleading because intercourse and artificial insemination are the only methods that I know for conceiving a baby. So he is prioritizing the intercourse and disregarding the monstrous criminal act of rape and the mental and emotional scar it causes a woman, by taking away her right to an abortion.

Now that almost every male Republican has offered up his party line opinion of rape (Paul Ryan says rape is but "...a method of conception") and it's rightful place in our social fabric, we can be completely at ease with the fact that these Republicans are, for the most part, quite heartless when it comes to what women have to go through just to bring them into this world, then live with some modicum of dignity through the Republican opinion of them.
How did every ones mother become the object of scorn? How did women become second class citizens and less than human? How could any woman vote for one of these reptiles?
